These general conditions are valid from 01/02/2011, furthermore they may be updated or modified at any time by SMT Europe sro which will communicate them through the pages of the website. The consumer undertakes and obliges, whenever there is a modification to these general conditions, to ensure that they are printed and stored.
· These general conditions concern the purchase of products, carried out remotely via a computer network via the website www.smtechnology.it belonging to SMT Europe sro by Neofood Trade sro Slovakia.
· "Online" sales contract means the distance contract, i.e. the legal transaction not having as its object movable goods and/or services stipulated between a supplier, SMT Europe sro with registered office in Lithuania and a consumer customer, as part of a distance sales system organized by the supplier who, for this contract, exclusively uses the distance communication technology called Internet.
· By consumer we mean the natural person who purchases goods and services for purposes not directly related to any professional activity carried out.
Art.1: ACCEPTANCE OF THE CONDITIONS OF SALE
1.1 The conditions set out in the introduction are an integral and essential part of this contract.
1.2 All purchase contracts will be concluded directly through access by the consumer customer to the website corresponding to the address www.smtechnology.it, where the customer will, in fact, be able to conclude the purchase of the desired good and/or product by carefully following the instructions and procedures provided.
Art. 2: SALE PRICES AND PURCHASE METHODS
2.1 All sales prices of the products displayed and indicated on the website, for which they constitute an offer to the public, include all types of taxes.
2.2 The total cost of shipping to the customer's home is borne by the customer. This cost will, in any case, be made known to the customer before confirming the purchase.
2.3 The purchase contract is finalized through the exact compilation and the consent to the purchase expressed through the "online" membership.
2.4 The customer can pay for the goods ordered using the payment methods indicated "online" at the time of purchase.
2.5 The prices of the goods ordered may vary between receipt of the order and its confirmation: such variations are always promptly communicated to the customer who has the right not to accept them and cancel the order.
Art. 3: DELIVERY METHOD
3.1 SMT Europe sro will deliver to customers, at the address indicated by the customer, the products selected and ordered, within 4 working days (if the product is available in the order), via couriers and/or shippers.
3.2 The purchased goods will be delivered within the terms indicated in the previous article. No responsibility can be attributed to the supplier for delayed or failed deliveries attributable to causes of force majeure or unforeseeable circumstances.
3.4 SMT Europe sro is not responsible for damage caused by the carrier to the purchased products.

In the event of problems, NOTHING WILL BE REFUNDED.

3.5 Attention: particular transport conditions may exist for some products. These conditions are reported on the product sheet.
Art. 4: PRODUCT AVAILABILITY
4.1 The customer will be able to purchase the products indicated in the electronic catalog prepared by SMT Europe sro, and in the quantities existing in stock upon notification of verification by the customer.
4.2 If an order exceeds the quantity existing in the warehouse, the IT system will accept the purchase limited to the available products.
Art. 5: RESPONSIBILITY
5.1 SMT Europe sro assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events which prevent, in whole or in part, from executing the sales and shipping contract within the agreed times.
5.2 SMT Europe sro will not be liable to any party or third party for damages, losses and costs suffered as a result of failure to perform the contract for the causes mentioned above, the consumer having the right only to a refund of the price paid.
5.3 SMT Europe sro is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, when paying for the products purchased.
Art. 6: GUARANTEES AND ASSISTANCE METHODS
6.1 SMT Europe sro markets high quality products. The producers of these goods offer a guarantee whose minimum duration depends on the type of product purchased. The guarantee starts from the day of purchase of the goods. This service is directly provided by the manufacturers of the goods. With the exception of modifications that do not fall within the original standards of the product itself.
For antennas the warranty will not be activated if the installation is not carried out by qualified personnel. Therefore the installation must be carried out by a specialized and authorized company that issues a certificate of installation and perfect functioning.
"BUROCRATIC" DEFINITION OF THE PRODUCT "EUROPE" and "ITALY"
Our country is part of the European Union and all products and services must be free to circulate.
For some products it is possible that the wholesale purchase price is lower than the price offered by traditional distribution channels. In these cases it is possible to purchase products coming from the European market.
These are identical objects in all respects to the product "officially" distributed in Italy: the Italian language is present, the accessories are present. Only the manual or instruction booklet in the original language (French, German, etc.) may differ but this manual can be easily downloaded and updated from the manufacturer's website.
The guarantee offered is the same: in the past some technical assistance laboratories have received instructions to deny assistance for these products, a directive promptly withdrawn upon the first legal complaints.

In short:
1. All products marketed by SMT Europe sro are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree no. 24/02. To benefit from warranty assistance, the Customer must keep the receipt that the system issues automatically at the conclusion of the order which he will find in his account at each access. The Customer will always be able to download the receipts relating to their purchases from the website www.smtechnology.it by accessing the reserved area.
2. The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation present inside the product packaging and present on the website www.smtechnology.it in the appropriate area. If, following intervention by an Authorized Assistance Centre, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any verification and restoration costs requested by the Authorized Assistance, as well as transport costs, if supported by SMT Europe sro.
3. The 24 month guarantee pursuant to Legislative Decree no. 24/02 applies to the product that presents a lack of conformity, provided that it is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee, in compliance with the Legislative Decree. N. 24/92, is reserved only for private consumers (natural persons who purchase the goods for purposes not related to their professional activity, or who make the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, SMT Europe sro will, at no cost to the Customer, restore the conformity of the product through repair/replacement or reduce the price, until the contract is terminated. If, following intervention by an Authorized Assistance Centre, there is no lack of conformity pursuant to Legislative Decree no. 24/02, the Customer will be charged for any verification and restoration costs requested by Authorized Assistance, as well as transport costs if supported by SMT Europe sro.
4. Replacements in the event of DOA (Dead On Arrival: product not working when first turned on), without prejudice to the existence of the conditions for the application of Legislative Decree no. 24/02, will be carried out only if expressly provided by the manufacturer. The times of replacement or possible repair of the product depend exclusively on the manufacturer.
5. In the event that, for any reason, SMT Europe sro is unable to replace a product under warranty (restored or replaced), it may proceed, subject to the Customer's consent, to replace the product itself (if still on the price list) or with another of equal characteristics and value or, finally, to issue a discount voucher of the same amount that can be spent on another product valid for 6 months from the moment of issue.
6. No damages can be claimed from SMT Europe sro for any delays in carrying out repairs or replacements of products under warranty.
7. In cases where the application of the guarantees requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc...); to limit damage to the original packaging, it is recommended, when possible, to insert it in a second box; In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided.
I. Warranty conditions
All products sold by SMT Europe sro are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree 24/02. To benefit from warranty assistance, the Customer must keep the previously requested receipt (or print the order proforma in his account) which he will receive via email in PDF format. By accepting the purchase contract, the customer acknowledges the assistance methods in force at the time of the warranty claim. Most of the products currently marketed by SMT Europe sro are covered by a direct guarantee at our headquarters,this is an advantage for the customer as the faulty product will be checked and replaced with a new product quickly directly by our staff. Some brands such as for example. Acer, Philips etc. offer a direct guarantee to the end user, also guaranteeing a quick and professional service.
II. Replacement times
The product replacement times from the time it arrives at our headquarters can vary from a minimum of 7 days to a maximum of 60 working days to allow our technical laboratory to carry out tests and checks on the product. Once the warranty rules have been verified and respected, the returns office will send the replacement product the day after the test has been approved.
Sending the new product is however not guaranteed within the times indicated above as it may not be available in stock, in this case our internal policy is committed to finding an agreement with the customer with the issuing of a purchase voucher for the commercial value of the goods purchased or replacement with an item of equivalent or superior characteristics. We specify that no damage can be requested from SMT Europe sro for a replacement of the product within the timescales indicated above.
III. Application opening - Request RMA number (return authorization code)
To obtain the RMA number to open a warranty claim on the purchased product, simply enter your control panel where you will find the "RMA Request" item. By filling out the various forms (all mandatory) with the requested data you will receive an email the following working day where you will be shown instructions on how to take advantage of the guarantee and the return RMA number. (IMPORTANT: Enter as detailed a description as possible of the fault found on the product, this will allow our technical laboratory to speed up testing times).
IV. When does the warranty expire?
The warranty is totally void if one of the following conditions is missing:
The absence of integral elements of the product (accessories, software, cables, manuals, parts,...)
The lack of presence of the original packaging (Point not valid if the products purchased were in the BULK version)
Damage to the product due to causes that are not guaranteed by the warranty regulations.
Purchase receipt issued more than 24 months ago.
Product arrived damaged during transport from the customer to the returns office
Product without warranty seals or serial codes
Products that have attempted overclocking (Via hardware or software.)
Final transistors and/or valves
Atmospheric agents of any TYPE
Antennas installed by unauthorized personnel
If the goods arrive at our returns center in the absence/violation of one of the points listed above, SMT Europe sro will consider the warranty conditions invalid. In this case the goods will be made available to the customer for collection at our warehouse for a maximum of 30 days. After 30 days, the product will be sent via our courier with a charge on delivery of €25.00.
Art. 7: BUYER'S OBLIGATIONS
7.1 The consumer undertakes and undertakes, once the "online" purchase procedure has been completed, to print and keep these general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased, in order to fully satisfy the condition.
7.2 These general conditions may be updated or modified at any time by SMT Europe sro which will communicate them via its website. The consumer undertakes and obliges, whenever there is a modification to these general conditions, to ensure that they are printed and stored.
7.3 The buyer is strictly prohibited from entering false, and/or invented, and/or imaginary data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively your real personal data and not those of third parties, or fictitious.
7.4 It is expressly forbidden to make double registrations corresponding to a single person or enter data of third parties. SMT Europe sro reserves the right to legally prosecute any violation or abuse,in the interest and protection of all consumers.
7.5 The Customer indemnifies SMT Europe sro from any liability deriving from the issuing of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer being solely responsible for the correct insertion.
Art. 8: AUTHORIZATIONS
8.1 By filling in the appropriate space on the website, the Customer authorizes SMT Europe sro to use their credit card, or other card issued in replacement of the same, and to debit their account in favor of SMT Europe sro with the total amount shown as the cost of the purchase made "online". The entire procedure is done via a secure connection directly connected to the banking institution that owns and manages the "online" payment service, which SMT Europe sro cannot access.
Art. 9: PRIVACY
9.1 Personal data is collected for the purpose of registering the customer and activating the procedures for the execution of this contract and the related necessary communications; these data are processed electronically in compliance with the laws in force and may only be exhibited upon request of the judicial authority or other authorities authorized for this purpose by law.
9.2 Personal data will be communicated to subjects delegated to carry out the activities necessary for the execution of the stipulated contract and disseminated exclusively within the scope of this purpose.
9.3 The interested party enjoys the rights, i.e. that at any time he can ask SMT Europe sro to know the nature and origin of such data, as well as request that it be updated, rectified, integrated or deleted, without prejudice to the right to object, in whole or in part, to such use.
9.4 Obtaining the cancellation of your personal data is subject to sending a written communication sent by fax or post to the company headquarters.
