Information on returns application of the right of withdrawal provided for by Legislative Decree 22 May 1999 No. 185, implementing Directive 97/7/EC issued by the European Union relating to the protection of consumers in relation to distance contracts. This right consists of the right to return the purchased good to the seller and the consequent reimbursement of the purchase price. The right of withdrawal applies to natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. Purchases made from retailers and companies are therefore excluded from the right of withdrawal. The customer can exercise the right of withdrawal by sending, within 14 working days, a formal request by registered letter with acknowledgment of receipt within 14 working days from the date of receipt of the goods to:
Upon receipt of the registered letter, SMT Europe will send the Customer via email the authorization to return the product to the SMT Europe logostoca headquarters within and no later than 10 days.
The right of withdrawal is subject to the following mandatory conditions:
the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, attached software,etc...);
the right does not apply to audio visual and electronic products a once opened and used;
the purchased good must be intact and returned in the packaging original, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc...); to limit damage to the original packaging, we recommend, when possible, placing it in a second box, on which to affix the RMA number (return authorization code) issued by SMT Europe; In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided;
the good subject to the exercise of the right of withdrawal must be returned in a normal state of conservation, as it has been kept and possibly used with the use of normal diligence: used products which show signs of damage or dirt and which consequently can no longer be considered intact will therefore not be accepted;
the good subject to the exercise of the right of withdrawal must report the same serial number present on the SMT Europe sales invoice; if the good shows a serial number different from that indicated on the invoice, the return will not be accepted and the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request;
the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the customer;
in the event of damage to the goods during transport, SMT Europe will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request;
SMT Europe is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
SMT Europe will refund the customer the entire amount already paid, in the shortest time possible and in any case within 30 days from the date of receipt of the withdrawal notice, upon receipt of the goods subject to the withdrawal, through a cancellation procedure of the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI Code - CAB - Current Account of the invoice holder).
The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where SMT Europe ascertains:
the lack of external packaging and/or packaging original interior;
the absence of integral elements of the product (accessories, cables, manuals, parts, ...) or anomalies in the product itself;
damage to the product for reasons other than its transportation;
a state of dirtiness of the product due to its use, which has compromised its integrity.
The return of products that are not intact, damaged or without original accessories and equipment, it will not be accepted by SMT Europe and will be returned to the sender with additional transport costs.
The refund excludes shipping costs (both for sending and returning the goods).
